Terms of Acquisition & Consignment
1. Scope & Covered Inventory
This agreement governs the representation and secondary market placement of fine art alabaster relief works by Donald Pollica, superseding previous net-pricing structures. These terms apply to all consigned works, specifically inclusive of the six (6) physical pieces currently held in inventory by RO Gallery.
2. Artist Floor Price Guarantee ($15,000 Net Minimum)
For every artwork sold through the gallery or its affiliates, the Artist shall receive a guaranteed floor amount of $15,000.00 USD (“Artist Floor”) directly from the gross proceeds of the final sale. This represents a non-negotiable minimum baseline allocation, payable directly to the Artist upon collection of funds from the ultimate buyer prior to the distribution of operating margins.
3. Percentage Split on Secondary Market & Auction Sales
While the Gallery maintains full discretion in establishing retail, secondary market, and auction pricing that reflects the museum-grade valuation of the pieces:
The Split: Any final gross sale price exceeding the $15,000 Artist Floor shall be distributed on a 60/40 percentage split—allocating 60% to the Artist and 40% to the Gallery for all proceeds realized above and beyond the $15,000 baseline.
4. Transparency & Transaction Verification
The Gallery is required to provide the Artist with a complete copy of the final sales receipt, collector acquisition record, and transaction settlement statement within 14 business days of a completed sale.
